The federal government spends more than $20 billion annually on contracts with service-disabled veteran-owned small businesses. But the rules governing SDVOSB eligibility can be complex and confusing – starting with the fact that the government runs not one, but two SDVOSB programs.

Event: APTAC Limitations on Subcontracting Session

For small businesses and their teammates, few topics in government contracting are as confusing as the limitations on subcontracting for set-aside and socioeconomic sole source contracts.  And if that isn’t stressful enough, the “LoS” is an area of heavy enforcement: get it wrong, and a contractor can face major penalties.  

Wouldn’t it be nice if someone would explain the limitations on subcontracting in plain English?  Well, if you’re a PTAC counselor, you’re in luck. On November 5, 2020, Koprince Law LLC Senior Partner Steven Koprince will present a session at the 2020 APTAC Fall Conference to help PTAC counselors and their clients understand and comply with this essential rule.

Event: Small Business Contracting Update & 2021 Preview

Fiscal Year 2020 is officially in the books. For small businesses in government contracting, it was a year of major changes–and many more changes are on their way in FY 2021.

On November 18, please join me (virtually) for “Small Business Contracting Update & 2021 Predictions,” sponsored by the National Contract Management Association, Boston Chapter. I’ll cover the biggest changes in FY 2020, from the HUBZone Program overhaul to WOSB certification to increases in the 8(a) Program economic thresholds. Then I’ll dust off my crystal ball and predict what’s on the way in FY 2021, including the long-awaited changes to the limitations on subcontracting and a revamping of the rules governing debriefings.

University of Texas San Antonio PTAC Legal Update

I’m pleased to announce a new learning opportunity from me and my colleague Steven Koprince! There’s been some big changes for government contractors over the last year, so it’s important to sort through them all.

To aid that process, we will be presenting “Government Contracts Legal Update 2020,” a virtual event hosted by the University of Texas San Antonio PTAC. The event will take place on October 22 from 1:00 PM – 2:30 PM (CDT). More information can be found here.

Thanks to the Missouri Procurement Conference 2019!

I recently returned from the Procurement Conference 2019 featuring Congresswoman Vicky Hartzler in Warrensburg, Mo. It was a great experience! The remarks of the Congresswoman, as well as those of keynote speaker the Hon. Alan Shaffer, Deputy Under Secretary of Defense Acquisition & Sustainment.

One theme they both touched on was that the Department of Defense is looking for great ideas from contractors and wants to pay well for those innovative ideas. That’s good news for federal contractors!

Thanks to all who organized the event, especially Bill Stuby with Missouri PTAC. I was able to provide an update on current issues in government contracting to a lively audience. And thanks to all who stopped by our booth to chat!

Compliant, Winning Teams: A Three-Part Webinar

Teaming and joint venturing are essential components of success for many small government contractors, and the emphasis on teaming is increasing in light of the SBA’s proposed rule allowing “similarly situated entities” to join together to pursue prime contracts.  But teaming and joint venturing are not without risks–there are many unique rules that must be followed, and many pitfalls for the unwary.

That is why I am very pleased to announced that I am joining with the Government Contractors Resource Network to present a three-part webinar series on compliant and effective teaming.  Directed at small contractors, this series will begin with an overview of the rules and regulations governing teaming.  The series will continue with a discussion of how to prepare effective and compliant teaming agreements, subcontracts, and joint venture agreements.  The series will wrap up with an in-depth discussion of federal mentor-protege programs, including the SBA’s new proposed “universal” mentor-protege program.
